The new Companies Act, 2008 (Act 71 of 2008) reinforces the provisions of the Protected Disclosures Act, 2000 (Act 26 of 2000 as amended) and in fact makes it mandatory for public and state-owned companies to “establish and maintain a system to receive disclosures … confidentiality, and to act on them.”
