Gotelee Guardian

Overview

Gotelee Guardian is a product safety due diligence app for electrical equipment, machinery / power tools, toys and cosmetics.

The app assists those in e-commerce distribution, eg. Fulfilment Houses and warehouse keepers, to comply with their product safety obligations.

In short, these are to take all reasonable steps and exercise all due diligence to check products and prevent unsafe products leaving the premises.

By following the app’s simple series of steps, Fulfilment Houses and warehouse keepers can identify products in their possession which do not comply with product safety requirements.

The app generates an audit trail to show that a product safety due diligence check has been completed on a specific date and time. A generated report enables the Fulfilment House and warehouse keeper to then take appropriate action to ensure that unsafe products do not leave the premises.

How it works

On First Use

The app user enters an email address. The generated product safety reports will then be sent to this email address. This may be the email address of the nominated compliance manager. The email address can be changed at any time.

Product Checking

1. The app user enters the product’s SKU number and a short description of the product.

2. The app user then selects the product type (electrical equipment, or machinery / power tools, or toys, or cosmetics).

3. The app user answers a short series of questions about the product.

A photo of the product can be taken by the app user at any stage. This is automatically linked to the answers.

Product Safety Reports

The app produces an on-screen report for the app user. The report confirms either 'Due Diligence Pass' or 'Quarantine'.

The app user can then take immediate action to store the products in the appropriate section of the warehouse.

If the result is 'Quarantine' the on-screen report highlights the identified product safety problem(s).

The app user is prompted to email the report.

The report contains the SKU number, product description, answers to the questions and any photos, and confirms the overall result ('Due Diligence Pass' or 'Quarantine').

Upon emailing the report, the app is cleared of data, ready for the next product check.

Audit Trail

The emailing of the report provides a clear documented audit trail to confirm that a product safety due diligence check has been completed on a specific date and time.

Taking Further Action

If the result is 'Quarantine’, the report contains a link to an FAQs page to assist the compliance manager in deciding upon the further action to be taken.

The compliance manager can send the report to the customer, so that the problem is clear to all.

Disclaimer and App Limitations

Use of this app does not:

1. Provide absolute confirmation that a product is safe. A product may display the correct safety related information but could still have a fault which renders it unsafe; or

2. Mean that you have fully complied with all reasonable steps and exercised all due diligence in relation to a particular product; or

3. Mean that you have entered into a retainer with Gotelee Solicitors for professional services.

You are responsible for checking for updates and updating this app.

Limitations of Liability

A. Subject to paragraphs B and C below, Gotelee Solicitors’ liability to you arising out of or in connection with your use of this app shall be limited to £2 million.

B. Subject to paragraph C below, Gotelee Solicitors will not be liable for any consequential, special, indirect or exemplary damages, costs or losses or any damages, costs or losses attributable to lost profits or opportunities arising out of or in connection with your use of this app.

C. Gotelee Solicitors only limits its liability to the extent the law allows. In particular, Gotelee Solicitors does not limit its liability for death or personal injury caused by its negligence or for fraud or fraudulent misrepresentation.
