MumboJumbo Responds To StoneLoops! Of Jurassica Controversy

About a week ago we reported that StoneLoops! of Jurassica had been pulled from the App Store at MumboJumbo's request due to "infringing Luxor copyright, confusing customers, stealing Luxor’s look & feel and even stealing their source code.”  MumboJumbo has now finally decided to respond to the controversy surrounding the removal, but has basically failed to clear up a single thing. After the story broke that MumboJumbo had gone directly to Apple to have StoneLoops! of Jurassica removed from the App Store due to copyright infringement, Gamasutra decided to try and get a statement from MumboJumbo since the original story was broke by Codeminion Development Studios co-founder Maciej Biedrzycki, the original creators of StoneLoops! of Jurassica.  MumboJumbo has every right to defend themselves and tell their side of the story, and here is their attempt:
"We are aware of the statement from Maciej Biedrzycki on the Codeminion website. It is replete with misleading statements and factual errors which do not accurately describe the events and circumstances leading to the removal of the infringing properties from the App Store." "As one of the first independent developers and publishers of casual games for all platforms, MumboJumbo has assisted the creation of many quality games from developers all around the world for almost a decade. "While MumboJumbo has always supported and promoted free and ethical competition, MumboJumbo has the right and the obligation to protect itself and its intellectual properties from infringement and unfair competition."
Doesn't really clear up much, does it?  MumboJumbo clearly believes that they are in the right here, which is absolutely possible, but for us to form a fair opinion we need to know what portion of Biedrzycki's statements were misleading or factually incorrect; although we probably won't be getting much more information any time soon since Biedrzycki and company are currently seeking legal advice to defend their rights and get StoneLoops! of Jurassica back in the App Store as soon as possible. I think the biggest question that remains is, how does MumboJumbo justify going after StoneLoops! of Jurassica and not the many other marble shooting game developers in the App Store?  From the outside looking in, it appears that they are only going after their biggest threat, which is obviously StoneLoops! of Jurassica.  Why not go after Tumblebugs or Atlantis Sky Patrol as well?  To take it one step further, why bother now?  StoneLoops! of Jurassica had been directly competing with Luxor on other platforms without any problems or concerns before. Maybe MumboJumbo needs to rethink their strategy.  What happens if PopCap launches Zuma for the iPhone and iPod touch?  Will they have the right to ask Apple to remove Luxor?
